مبادئ يوغياكارتا والدليل
في نوفمبر/تشرين الثاني 2006، وفي يوغياكارتا بأندونيسيا، اجتمعت مجموعة بارزة من خبراء حقوق اإنسان، من مختلف المناطق والخلفيات، ومنهم القضاة والأكاديميين وخبراء الأمم المتحدة وأعضاء في هيئات تابعة لاتفاقيات، وممثلين عن المنظمات غير الحكومية، وقد اجتمعوا لوضع مجموعة مبادئ يطبقها قانون حقوق الإنسان الدولي على قضايا التوجه الجنسي والهوية الجنسية.
وتم عقد الاجتماع من قبل اللجنة الدولية للمُشرعين والخدمة الدولية لحقوق الإنسان، بدعم من منظمات حقوقية أخرى. ومع توجيهها إلى الأمم المتحدة وغيرها من الهيئات الحكومية الدولية ورؤساء الدول وصناع السياسات، أصبحت المبادئ معروفة باسم "مبادئ يوغياكارتا حول تطبيق القانون الدولي لحقوق الإنسان فيما يتعلق بالتوجه الجنسي وهوية النوع". وصدق على مبادئ يوغياكارتا 29 خبيراً بمن فيهم مفوض سابق للأمم المتحدة لحقوق الإنسان. وتم الإعلان عنها في مجلس حقوق الإنسان بالأمم المتحدة في جنيف بتاريخ 26 مارس/آذار 2007.
وتُلخص مبادئ يوغياكارتا في وثيقة واحدة كيفية معاملة القانون الدولي الحالي للأشخاص المثليات والمثليين وذوي التفضيل الجنسي المزدوج والمتحولين جنسياً. وهي ذات أهمية خاصة في وضعها قضايا هوية النوع على نفس المستوى مع التوجه الجنسي. وتؤكد على المعايير الدولية المُلزمة التي يجب أن تفي بها كل الدول، وهي ما يخص القضاء على العنف والتمييز، وضمان الفرص المتساوية من حيث الحقوق الاقتصادية والاجتماعية، والحماية من الإساءات الطبية وضمان الحق في الصحة، وفي حماية العائلات والترويج للمساواة بشكل نشيط.
والمنظمة التي قادت هذه العملية تقوم الآن بإعداد "دليل النشطاء لمبادئ يوغياكارتا"، وهو ترجمة للمبادئ في لغة أكثر سهولة ويسراً في الاستخدام مع أمثلة على أفضل الممارسات في تطبيق المبادئ في سياقات متعددة.
وبما أن مبادئ يوغياكارتا متوافرة منذ فترة قصيرة نسبياً، فإن جهودنا لن تكون فقط هي بحث الاستخدام الفعلي للمبادئ، بل أيضاً رصد المبادرات الحديثة للنشطاء بمجال المثليات والمثليين وذوي التفضيل الجنسي المزدوج والمتحولين جنسياً والمتصلة بالمبادئ حتى لو كانت لا تُستخدم فيها بشكل صريح.
وسوف يرمي "دليل النشطاء لمبادئ يوغياكارتا" إلى جعل المبادئ سهلة الفهم بالكامل لتُستخدم كأداة للدفاع عن الحقوق على المستوى المحلي. وتحديداً سوف يقوم الدليل بالآتي:
- وضع المبادئ في لغة مفهومة وقابلة للاستخدام.
- تقديم الأمثلة على أفضل الممارسات وأساليب تنظيم الحملات بشأن القضايا التي تتصدى لها المبادئ.
- الربط بين المبادئ والنشاط وتنظيم الحملات في القضايا ذات الصلة، خاصة في النشاط بمجال النوع (الجندر) وحقوق المرأة، على المستويين المحلي والدولي.
- منح فرصة للمقارنة بين الرؤى من مختلف الثقافات والحضارات إزاء الإستراتيجيات الواجب تبنيها بغض النظر عن الحدود الثقافية والحضارية.

Call for Contributions: Activists' Guide to the Yogyakarta Principles

The Yogyakarta Principles and the Guide
In November 2006, in Yogyakarta, Indonesia, a distinguished group of human rights experts, from diverse regions and backgrounds, including judges, academics, UN experts, members of treaty bodies, and NGO representatives met to adopt a set of principles on how international human rights law applies to issues of sexual orientation and gender identity.
The meeting was convened by the International Commission of Jurists and the International Service for Human Rights, with the support of many other human rights organizations. Addressed to the United Nations, to other intergovernmental bodies, and to national leaders and policymakers, the principles became known as the "Yogyakarta Principles on the Application of International Human Rights Law in Relation to Sexual Orientation and Gender Identity." Ultimately, 29 experts, including a former UN High Commissioner for Human Rights, endorsed the Yogyakarta Principles. They were launched at the UN Human Rights Council in Geneva on March 26, 2007.
The Yogyakarta Principles sum up in one document how current international law treats the rights of lesbian, gay, bisexual, and transgender (LGBT) people. They are particularly notable in placing gender identity issues on the same plane as those of sexual orientation. They affirm binding international standards with which all states must comply: in ending violence and discrimination; in ensuring equal opportunities in economic and social rights; in protecting against medical abuse and ensuring the right to health; in safeguarding families; and in actively promoting equality.
The organizations that led this process are now developing an Activist's Guide to the Yogyakarta Principles, which would translate the principles into accessible and usable language and provide a sampling of best practices in applying the principles in various contexts.
Since the Yogyakarta principles have been available for a relatively short period of time, our effort will be not only to chart out the actual usage of the principles--but also to map out recent initiatives in LBGTI activism that are relevant in terms of the principles even if they do not use them explicitly.
The Activist's Guide to the Yogyakarta Principles will aim to make the principles fully accessible as a tool for local advocacy. Specifically, the guide will:
- put the principles in understandable and usable language;
- offer best practices for lobbying and campaigning around the issues addressed in the principles;
- tie the principles to previous activism and campaigning around related issues—particularly the long histories of gender and women's rights activism, at domestic and international levels;
- include an opportunity for cross-cultural reflection on what strategies might work or might be adapted across cultural boundaries.
